Sydney presented a CPD seminar titled “The intersection between subdivision law and easements” on 8 June as part of the Legalwise Subdivision Law Intensive series.
The presentation explored the ways in which subdivision law and easements frequently interact for the property practitioner, including:
- When by-laws may be more or less appropriate than easements for the purpose of conferring rights over land
- How courts assess whether an easement purports to give exclusive possession, and is therefore invalid
- How representations made to the Owners Corporation can give rise to an easement by estoppel
- How to best navigate constructional disputes around an easement
