On 29 August, Sydney presented a CPD seminar for Legalwise titled No Transaction, Successful Transaction. The presentation explored the distinction between ‘no transaction’ and ‘successful/different transaction’ cases, which can have a significant effect on the damages a plaintiff recover in an action for negligent misstatement, or misleading and deceptive conduct.
Topics covered included:
- General principles relating to the difference between a ‘no transaction’ and ‘successful transaction’ case.
- How the principle has been applied to actions in negligent misstatement causing economic loss.
- Examples of the principle being applied to misleading and deceptive conduct under the Australian Consumer Law.
